随着中国不断的发展,经济实力越来越强,社会上滋生了大量腐败分子,以及从事各种犯罪活动的人,他们无时无刻不在影响人民的生命财产安全,损害国家利益。为了完善我国刑法法律,针对在我国刑法中因某些原因而导致的、在没有相关法律的规定下使用非法手段所得的财产不能有效处理的类似情况,设立了特别程序。本文主要阐述了对新刑法所得没收程序的意义,并且对一些重要的程序进行解读,从而使读者更加了解相关法律程序。
With the continuous development of China, its economic strength is getting stronger and stronger. There are a great number of corrupt elements and people engaged in various criminal activities in society. They all over the world affect the lives and property of the people and harm the interests of the country. In order to perfect the criminal law in our country, a special procedure has been set up for the similar situation in China’s criminal law which is caused by some reasons and whose property obtained by illegal means can not be dealt with effectively without the relevant laws. This article mainly expounds the meaning of the confiscation procedure obtained from the new criminal law and interprets some important procedures so as to make the readers better understand the relevant legal procedures.
