在任何形式的武装冲突中,平民都应受到尊重和保护,但在非国际性的武装冲突中,对平民法律地位的界定尚无统一的标准和方法。探讨在理论和实践中都可行的平民的法律地位和方法具有十分重要的意思。本文试图从确定武装冲突的法律性质,辨明平民的身份及其与其他冲突受难者的区别的基础上,分析非国际性武装冲突中平民应受保护的权利和自由,为界定非国际性武装冲突中平民的法律地位提供基本的法律依据。
In any form of armed conflict, civilians should be respected and protected, but there is no uniform standard and method for defining the legal status of civilians in non-international armed conflicts.
