私法自治与合同自由原则是民法的重要原则,但随着经济的发展,消费者和经营者相比,逐渐处于弱势地位,因此对于两者在特殊条件下签署的合同,应给予撤销权,以保障消费者的权益,同时特殊合同中的撤销权制度,并非对合同自由原则的违背,而是对合同自由原则的实质性实现。德国债权的民法化后,其中的消费者撤销权制度对保护消费者扮演着举足轻重的角色,因此对德国民法典中消费者撤销权的研究,对我们理解消费者撤销权制度有着重要作用
