双边保障措施制度是区域贸易协定特有的一项贸易救济制度。本文首先对双边保障措施制度的含义予以澄清,之后选取最具代表性的NAFTA双边保障措施制度进行深入研究,最终找出了现有中外自由贸易协定双边保障措施制度的不足,提出构建未来中外区域贸易协定双边保障措施制度的设想。本文建议:未来中外区域贸易协定应借鉴NAFTA的相关规定,从严规范双边保障措施制度。
The system of bilateral safeguards is a trade remedy unique to regional trade agreements. This article firstly clarifies the meaning of the system of bilateral safeguard measures and then selects the most representative system of bilateral safeguard measures of NAFTA for further study. Finally, it finds out the insufficiency of the existing system of bilateral safeguard measures for free trade agreements between China and foreign countries, Assumption of Bilateral Safeguards System in Trade Agreements. This paper suggests that in the future, the RTAs between China and foreign countries should learn from the relevant provisions of NAFTA and strictly regulate the bilateral safeguards system.
