德治与法治历来是一个国家进行政治统治必然要进行选择的治理方式,中国几千年传统文化多以“人性善”为哲学依据,由此衍生出德治的传统理念,即使在“人性恶”的理论基础上建立起来的法治,亦包含了西方法治思想所不具备的德治内容。人性论哲学与社会治理思路密切相关,挖掘其间所存在的逻辑演进关系,是当代中国确立合理的治国方针所必须的理论根源。
The rule of virtue and the rule of law have always been the governing style that a country must inevitably have to make its own choice. The traditional culture of China for thousands of years is mostly based on the philosophy of “human nature”, thus deriving the traditional concept of governing by virtue. The rule of law established on the basis of the theory of “human evil” also contains the content of the rule of virtue not found in the western thought of the rule of law. The philosophy of human nature is closely related to the ideas of social governance. To excavate the logical evolution between them is the necessary theoretical basis for establishing a reasonable policy of running the country.
