环境公益诉讼制度为公民实现其环境权提供了保障。英美等国都建立了各自的环境公益诉讼制度,但是环境公益诉讼在我国存在制度缺失。本文简述了国外环境公益诉讼制度,分析了我国构建环境公益诉讼制度的必要性和可行性,指出可借鉴外国相关立法模式,构建我国的环境公益诉讼制度。
Environmental public interest litigation system provides citizens with the protection of their environmental rights. Britain and the United States and other countries have established their own environmental public interest litigation system, but the existence of environmental public interest litigation in our country is missing. This article briefly describes the system of environmental public interest litigation in foreign countries, analyzes the necessity and feasibility of constructing environmental public interest litigation system in our country, and points out that we can draw lessons from foreign related legislative models and construct our environmental public interest litigation system.
