周日和节日的历史渊源在德国与基督教信仰有着极密切的联系,这赋予了周日和节日宗教语境下的特殊含义。在美国法中这属于Blue Law(蓝色规范)的特殊领域,在德国《基本法》中用来规范周日和节日问题的是Art.140GG i.V.m.Art.139 WRV(第140条之魏玛宪法第139条)。这一条款正是通过对魏玛宪法中归属于宗教事务项下的一揽子条款的整体接受才最终进入到《基本法》之中;而且周日和节日保护的宪法目标也清楚表明了其所具有的宗教(或文化)和社会的双重含义。以此宪法规定为基础,德国联邦和州在一般法层面上具体形塑出了对周日、节日进行法律保护的整体框架。
The historical origins of Sundays and festivals are closely related to the Christian faith in Germany, which gives special meaning to the religious context of Sunday and festivals. This is a special area of Blue Law in American law. The issue used to regulate Sunday and holiday issues in the German “Basic Law” is Art. 140GG iVmArt.139 WRV (article 140 of the Weimar Constitution 139). This clause finally entered into the “Basic Law” through the overall acceptance of the package of articles pertaining to religious affairs in the Weimar Constitution. And the constitutional goals of Sunday and holiday protection also make it clear that what they have Religious (or cultural) and social dual meaning. Based on this constitutional provision, the German federal and state specifically shaped the general framework for legal protection of Sundays and holidays at the level of general law.
