本文从审判实务的角度,对预告登记制度的几个问题进行了初步探讨。全文共分两大部分:(1)预告登记的主要内容,介绍了预告登记的概念与价值,探讨了预告登记的效力。(2)探讨了预告登记纠纷审理中的两个疑难问题:①中间处分行为和中间处分合同的效力问题;②预告登记的债权与相关权利包括建筑工程款优先权、抵押权和未经预告登记的债权冲突的法律适用问题。
This article from the perspective of trial practice, pre-notice registration system for a number of issues were discussed. The full text is divided into two parts: (1) The main content of advance notice registration, introduced the concept and value of advance notice registration, and discussed the effectiveness of advance notice registration.
