关于我国是否应该成立仲裁协会的讨论,近20年来一直停留在理论层面的争论中。随着我国仲裁事业的高速发展,组建仲裁协会的时机越来越成熟,但对成立与否仍然存在一定争议。本文试图通过从仲裁机构的现状入手,理清仲裁协会为什么要成立、如何成立以及成立何种模式的仲裁协会等存在争议的问题,说明我国现阶段已经具备成立仲裁协会的环境,可以着手组建中国仲裁协会。
The discussion on whether or not China should set up an arbitration association has remained at the theoretical level for nearly 20 years. With the rapid development of arbitration in our country, the time is ripe for the establishment of arbitration association, but there is still some dispute about the establishment or not. This article attempts to start with the status quo of arbitration institutions, to clarify why the Arbitration Association was founded, how to set up and what model arbitration association should be set up, and so on. This shows that China now has the environment to set up an arbitration association and can start to set up China Arbitration Association.
