辩诉交易的存在有其特定的制度背景与价值取向,我国不具备辩诉交易的生成环境,该制度与我国刑事诉讼的价值取向有冲突且违背了其基本原则。我国不应该付出巨大的社会代价去引入辩诉交易制度。
The existence of plea bargaining has its own specific institutional background and value orientation. Our country does not have the environment for the formation of plea bargaining. This system conflicts with the value orientation of criminal litigation in our country and runs counter to its basic principle. Our country should not pay a huge social cost to introduce plea bargaining system.
