《中华人民共和国城市房地产管理法》于1995年1月1日起正式生效,对房地产转让,出让,出租和抵押等作出了明确规定。笔者认为,应当注意的是签订房地产合同时除应运用房地产法规指导外,还应注意掌握不同合同的特点。签订房地产抵押合同应注意掌握的事宜有如下几点: 一、注意合同主体资格的合法性 合同主体资格合法是指签约房地产抵押合同的抵押人和抵押权人,是否具有权利能力和行为能力。不具备以上能力的主体签订的抵押合同无效不受法律的保护。
