国际刑事法院对非缔约国公民的强制管辖权与国家主权之间的矛盾与冲突,一直是国际法学界关注的焦点,也是国际刑事法院实践中最受争议的方面。国际刑事法院对非缔约国公民的强制管辖权作为一种补充原则下的普遍管辖权,是有限国家主权理论的体现,是国际法理论新的发展。尽管目前国际刑事法院在对非缔约国公民行使管辖权的实践中遭遇到一些困境,特别是在苏丹达尔富尔案中,受到了涉案人及有关国家的抵制,但随着缔约国的增加,通过与非缔约国的有效合作,其必然会对国际刑事司法的发展和人权保护发挥越来越大的作用。
Conflicts and conflicts between the ICC’s mandatory jurisdiction over citizens of non-Contracting States and state sovereignty have always been the focus of attention of international jurisprudence and the most controversial aspect of ICC practice. The International Criminal Court’s compulsory jurisdiction over citizens of non-signatory nations as a supplementary principle under universal jurisdiction is a manifestation of the theory of sovereignty in a limited country and a new development of the theory of international law. Although at present the ICC has encountered some difficulties in exercising its jurisdiction over citizens of non-Contracting States, especially in the case of Darfur in the Sudan, it has been boycotted by the people involved and the countries concerned. However, as the number of Contracting States increases, The effective cooperation of non-signatory states will inevitably play an increasingly greater role in the development of international criminal justice and the protection of human rights.
