电子交易作为现代信息和通信技术最重要的应用领域之一,与传统商业交易模式有所不同。为保护消费者利益,针对当代电子交易中存在的“费用陷阱”而使消费者利益受到损害的问题,自2012年8月1日始,在德国生效施行了《关于在电子交易费用陷阱问题上更好保护消费者而修改民法典和住房所有权法的法律》。新法规定,经营者与消费者之间进行的电子交易,涉及有偿服务的,经营者不再允许仅提供简单的商品信息,而规定在消费者发出订单前,由经营者将商品的重要特征等信息作为信息义务,提供给消费者。这些信息不仅要公开透明,而且要在消费者发出订单前“以特别的方式”呈现。新法为消费者捍卫自己的权利提供了新的法律基础,规范了经营者的信息义务。本文通过阐释新法、讨论新法在实践中遇到的问题、剖析新法的出台背景与立法精神,最终为完善我国的《消费者权益保护法》提供借鉴意义。
As one of the most important applications of modern information and communication technology, electronic transactions are different from the traditional business transaction modes. In order to protect the interests of consumers, the issue of compromising the interests of consumers against the “cost trap” existing in contemporary electronic transactions has come into force in Germany since August 1, 2012. The new law provides a new legal basis for consumers to defend their rights and regulates their information obligations. This article explains the new law, discusses the problems encountered in the practice of the new law, analyzes the introduction of the new law background and the spirit of legislation, and ultimately provide reference for the improvement of China’s “Consumer Protection Law.”
