教师惩戒权的法律属性应当界定为权力(power),而非权利(right),因为惩戒权符合权力的适用规则,又属于不能放弃和自由处分的权能属性;从法律规范的构成要素探究,校园内的校纪校规的实现,不能缺少教师惩戒权;从禁止权利滥用原则探析,教师惩戒权在校园内存在合理性;从受教育权的内容分析,惩戒权是受教育权的一部分;通过程序的设计和对惩戒权内容的限制两方面立法,可以排除教师惩戒权的负面影响。
