微信作为代表新媒体前沿技术的应用服务,其内在技术逻辑复杂,在认定微信平台方的义务与责任时,我们须在传统保护模式的基础上融合对新技术发展的特点进行思考。注意义务及其标准对认定平台的侵权责任及其范围至关重要,对于微信平台来说,应以其预见能力和预见范围为基础,按照公示性程度和合法性判断难度的高低来设定注意义务标准。针对不同账号类型、认证方式,微信平台的注意义务不尽相同。如违反注意义务,应按照过错原则对平台的责任予以认定。平台对外承担连带责任后,有权向直接侵权人追偿。
