谷歌在未经中国著作权人授权的情况下擅自将570位权利人的著作进行扫描并放入其数字图书馆供读者观看,严重侵犯了中国作家的权益。随着网络技术的快速发展,通过信息网络传播权利人的作品越来越普遍。种种迹象表明我国在数字版权保护的建设背后,存在着数字版权保护政策、法律的缺失。未来的出版业前景是数字出版,政府把目光放到传统出版业中是远远不够的。现有法律适用于数字网络环境时明显滞后,需要及时修改和完善,以适应现代信息技术的发展要求和版权产业发展的需要,信息网络传播权的内涵和外延也需要调整。
Without the authorization of the copyright owner in China, Google scans the books of 570 right holders and puts them into their digital library for readers’ viewing, which seriously infringes upon the rights and interests of Chinese writers. With the rapid development of network technology, it is more and more common for the dissemination of rights holders’ works through information networks. There are indications that behind the construction of digital copyright protection in our country, there is a lack of digital copyright protection policies and laws. The future of the publishing industry is digital publication, and it is far from enough for the government to focus its attention on the traditional publishing industry. Existing laws are obviously lagging behind when applied to the digital network environment and need to be revised and improved in time to meet the requirements of the development of modern information technology and the development of the copyright industry. The connotation and denotation of the right of information network dissemination also need to be adjusted.
