以美国“反托拉斯法”为蓝本制定的日本反垄断法,经过半个多世纪的不断修正和“本土化”改造,已逐渐融入日本法律传统中并充满自身的特色。鉴于目前我国正处于经济赶超阶段,很多情况与日本当年情况相近,认真考察日本反垄断法“本土化”过程将对我国反垄断立法具有重要的借鉴意义。
Japan’s antitrust law based on the United States “Antitrust Law ” has gradually been integrated into the Japanese legal tradition and filled with its own characteristics after more than half a century of continuous revision and “localization ” reform. In view of the fact that our country is currently in the stage of economic catching-up, many situations are similar to those in Japan. A careful examination of the Japanese “anti-monopoly law” process will have an important reference for the anti-monopoly legislation in China.
