以区分所有形态存在的建筑物中的专有部分与共有部分的划分,具有重要意义。最高人民法院《关于审理建筑物区分所有权纠纷案件具体应用法律若干问题的解释》进一步明确了《物权法》中的有关规定。笔者在对法律和司法解释相关规定进行分析的基础上,认为区分所有建筑物的专有、共有范围尚有可进一步探讨之处,提出不宜将所有的公用设施、公共场所简单的全部归属业主共有。应该在维护业主共同利益的前提下,依“谁投资,谁所有”的原则及民事主体之间的特别约定,视具体情况而定。
In order to distinguish all forms of existing buildings in the proprietary part of the common part of the division, is of great significance. The Supreme People’s Court, “Interpretation on Several Issues Concerning the Specific Application of Law in the Trial of Disputes over the Ownership Differentiation of Buildings” further clarified the relevant provisions of the “Property Law”. On the basis of the analysis of the relevant provisions of law and judicial interpretation, the author thinks that the exclusive and common scope of all buildings can be further explored. It is suggested that all public facilities and public places should not be totally owned by owners . The principle of “who invests, who owns everything” and the special agreement between civil entities should be maintained on the common interests of owners, depending on the circumstances.
