关于工资的定义,对价理论和关系正义理论的争议无助于解决当下问题,应转向以法律解释为基本方法的法教义学研究,逐步形成共识或通说。借助劳动法的体系效益和现存立法的目的论探究可以明晰工资定义的涵摄范围;工资外延的目的性扩张解释可以有效应对复杂的工资支付实践;对福利的限缩解释有助于劳动者的权利保障和工资支付“福利化”“恩惠化”的司法应对。工资应该是劳动关系存续期间用人单位依据劳动合同或者法律规定支付给劳动者的报酬,不包括用人单位支付的保险福利费用及其他劳动收入。劳动法案例指导制度和工资集体协商制度的构建有利于工资定义适用规则的完善。
The controversy over the definition of wage, the theory of value and the theory of relational justice will not help to solve the current problems. Instead, we should shift to the study of law and doctrine with the explanation of law as the basic method and gradually form a consensus or explanation. With the aid of the system efficiency of labor law and the purposive theory of the existing legislation, it is possible to clarify the scope of the definition of wage coverage; the purposeful expansionary explanation of wage extension can effectively deal with complicated wage payment practices; the narrowing and explanation of benefits helps workers Right protection and wage payment “welfare ” “grace ” judicial response. Wages should be the remuneration paid by the employer to the worker according to the labor contract or the law during the existence of the labor relationship, excluding the insurance and welfare expenses and other labor income paid by the employer. The construction of the labor law case guiding system and wage collective bargaining system is conducive to the improvement of the applicable rules of wage definition.
