小产权房是指存在于城市近郊的属于农民集体所有的土地上的房屋,没有国家房管部门颁布的产权证书。我国目前房价居高不下,这使得小产权房有了活跃的市场。政府严厉打击小产权房的交易。但是小产权房带来的一系列问题,拆迁和征收时购房者的合法利益得不到保护,房屋质量得不到保障等等,这些问题都需要完善我国关于小产权房的立法问题,是小产权房合法化,使问题得到根本解决。
