认定立功历来是司法实践的难点之一,当前对立功的司法审查程序存在诸多细节上的问题,这些问题的解决在于对相关程序的规范。而在对立功进行司法审查中,其难点有三,即:对立功线索的司法审查、立功“查证属实”的司法认定、对“协助抓捕型”立功的司法认定,本文立足司法实践对此作了较为详细的论述。
