不动产预告登记的适用范围在很大程度上决定了不动产预告登记制度的功能可否充分的发挥。我国《物权法》虽明确规定预告登记制度,但对其适用范围规定得过于原则,且有狭小之嫌。《土地登记办法》和《房屋登记办法》虽对预告登记的适用范围进一步明晰,但依然有值得完善的空间。依土地权利出让协议、抵押权转让协议,拆迁安置协议等应该可以申请预告登记,附条件或附期限不动产物权的请求亦应纳入预告登记适用范围。
The application scope of real estate advance notice registration largely determines whether the function of real property advance notice registration system can fully play. Although China’s “Property Law” clearly stipulates the advance notice registration system, its application is outdated and out of its scope. Although the “Land Registration Measures” and “Housing Registration Measures” further clarify the scope of application for advance notice registration, there is still room for improvement. According to the land rights transfer agreement, the mortgage transfer agreement, the demolition resettlement agreement should be able to apply for advance notice of registration, conditional or fixed term real property claims should also be included in the notice of registration of the scope of application.
