传闻排除规则是英美法系证据法中最古老、最复杂、最重要的规则之一。但是随着时代的发展以及科学技术的进步,支持传闻排除规则的传统观点已经愈来愈多地受到了多方质疑,并且对传闻证据的发展趋势有了新的认识。主要从对传闻排除规则的传统支持理论进行反驳的角度来重新认识它,进而得出传闻排除规则的发展将是一个越来越宽松的状态,并可能终将走向灭亡的结论。
Rumor exclusion rules are one of the oldest, most complex and most important rules in the Anglo-American legal system. However, with the development of the times and the progress of science and technology, the traditional view of rumors exclusion rules has been increasingly questioned by multiple parties and a new understanding of the development trend of hearsay evidence has been obtained. It mainly re-recognizes it from the point of view of refuting the traditional support theory of rumor exclusion rules, and concludes that the development of rumor exclusion rules will be a more and more relaxed state and may eventually reach the conclusion of extinction.
