《刑法修正案(九)》再次强调了编造、故意传播虚假恐怖信息罪的重要性,现实中虚假信息也以扩大的趋势影响着民众的正常生产生活秩序。本文从本罪的构成要件及与相似罪名的比较两方面,对本罪在法律上的适用进行了一定的梳理。
The Amendment to the Criminal Law (IX) once again emphasizes the importance of the crime of fabricating and deliberately spreading false terrorist information. In reality, the false information also affects the public’s normal order of production and life with an expanding trend. Based on the constitutional elements of this crime and the comparison with similar charges, this paper sorts out the legal application of this crime in some aspects.
