警察在履行职务时不可避免地会遇到抗拒甚至暴力的侵袭,如果警察对武力使用的内涵及程序不清晰,将会无法正常履行职责,甚至自身安全也不能得到保证。而现阶段我国警察的武力使用在法律界定和实际操作中都存在一些问题,本文拟借鉴国外及其他地区的经验,对我国应然的武力使用策略进行探讨,为我国警察合理使用武力提供解决路径。
When performing their duties, the police will inevitably encounter resistance or even violent attacks. If the police force and the procedure for using force are not clear, they will not be able to perform their duties properly and their own safety will not be guaranteed. At present, there are some problems in the definition and practice of the use of force by the police in our country. This paper draws lessons from the experiences of other countries and regions and probes into the tactics of the use of force that should be applied in our country so as to provide a solution to the reasonable use of force by the police in our country .
