随着经济交往形式的日益复杂化,再加上经济犯罪发生原因的多重性,经济犯罪形式呈现出多样性、多变性、多发性的特色。经济犯罪的这种新特点要求我们必须深化对其调控规律、调控手段的认识。经济犯罪的发生和演变具有区别于传统犯罪的特点,对这些特征性表现的深刻理解是实现对此类犯罪有效规制的前提。在此基础上。反思经济犯罪刑法规制面临的困境并重构其制度才能使经济犯罪的防控更具规范化。
