民事诉讼证据制度,是民事诉讼的核心和灵魂。而非法证据排除规则作为证据规则的重要组成部分自然引起了广泛的关注。非法证据排除规则最早适用在刑事诉讼法范围内,由于人们对司法正义的呼声越来越高涨,民事诉讼领域内的非法证据排除规则越来越引起学界广泛的注意。我国现有的民事诉诉法非法证据排除规则还存在很多不足之处,亟待完善。
The civil evidence system is the core and soul of civil litigation. The exclusion of illegitimate evidence as an important part of the rules of evidence naturally aroused widespread concern. The rule of exclusion of illegal evidence was first applied within the scope of the Code of Criminal Procedure. Due to the increasing demands for judicial justice, rules of exclusion of illegal evidence in the field of civil litigation have drawn more and more attention in academia. There are still many shortcomings in the existing rules of exclusion of illegal evidence in Civil Litigation Law in China, and it needs urgent improvement.
