高三《思想政治》就国际法概念作了如下表述;“国际法是各国公认的调整国家关系的有约束力的原则、规则、制度的总称。简单地说,国际法就是调整国家之间关系的法律。”这一定义值得商榷。一、“国际法是各国公认的调整国家关系的有约束力的原则、规则、制度的总称”这一提法不完全正确现代国际法的法律形式主要有两种,即国际条约和国际惯例。国际条约在国际法上占有特别重要的地位,它是国际交涉最重要的法律形式,也是现代国际法的最主要渊源。国际法的基本原则和重要规范大都是以条约的形式固定下来的。在一切适合国际法的场合,国际条约所固定的原则和规范是首先被适用的。在现代国际法原则基础上国家间缔结的双边或多边条约无疑是国际法的组成部分。条约是两国或数国之间规定它们权利和义务关系的法律文
The third year “Ideology and Politics” made the following statement on the concept of international law; “International law is a general term for binding principles, rules, and systems recognized by all countries for the adjustment of relations between nations. In simple terms, international law is a law that regulates relations between nations. ”This definition is debatable. I. “International law is universally recognized as the general principle of the binding principles, rules, and systems that govern state relations.” This formulation is not entirely correct. There are two main legal forms of modern international law: international treaties and international conventions. International treaties occupies a particularly important position in international law. It is the most important legal form of international representation and the main source of modern international law. The basic principles and important norms of international law are mostly fixed in the form of treaties. In all cases where international law is appropriate, the principles and norms fixed by international treaties are applied first. Bilateral or multilateral treaties concluded between countries on the basis of modern international law principles are undoubtedly part of international law. A treaty is a legal document that stipulates the rights and obligations between two countries or countries.
