本文分析了主要发达国家和发展中国家专利制度发展概况,总结了各国专利制度从特色到融合的动态演进过程特点,提出目前专利制度协同管理主线,包括:专利申请数量与专利申请质量协同;专利制度国家特色与国际标准的协同;专利制度与产业政策及区域政策的协同;专利存量的利用与专利增量的开发协同等。从差异中走向融合,在融合中保持差异,可以大略概括为世界专利制度的改革走向,这为中国专利制度协同发展提供了参考。
This paper analyzes the development of the patent system in major developed and developing countries, summarizes the characteristics of the dynamic evolution of the patent system in each country from the characteristics to integration, and puts forward the main line of synergetic management of the current patent system, including: the number of patent applications and patent application quality synergies; patents Synergy of system national characteristics and international standards; synergies between patent system and industrial policies and regional policies; utilization of patent stock and synergies in the development of patent increment. From differences to convergence and differences in convergence, we can roughly sum up the reform direction of the world patent system, which provides a reference for the synergetic development of China’s patent system.
