宪政自清末传入中国,到今天,已有了百年的历史,然中国宪政建设仍尚待完成,主要原因就在于没有正确把握好公民权利和国家权力之间的关系。本文试对宪政体制下公民权利与国家权力间的关系进行分析,以期对处在社会转型时期的我国宪政建设做些有益的思考,从而推动我国宪政进程。
Since the introduction of constitutionalism into China from the end of Qing Dynasty, to this day, there has been a hundred years of history. However, the construction of China’s constitutional government still remains to be completed. The main reason lies in the fact that the relationship between civil rights and state power has not been correctly grasped. This paper tries to analyze the relationship between citizens’ rights and state power under the constitutional system in order to do some useful thinking on the constitutional construction of our country in the period of social transformation so as to promote the process of constitutional government in our country.
