本文着眼于我国演绎作品的著作权归属及行使规则展开研究。全文共分为四个部分,第一部分主要探讨演绎作品的认定问题,即演绎作品之构成要件;第二部分主要围绕演绎作品,尤其是侵权演绎作品的著作权归属问题展开研究;第三部分探讨并试图明确演绎作品著作权行使的规则及其界限;小结部分则就我国现行《著作权法》中有关演绎作品规定的欠缺之处略述己见。
This article focuses on China’s deductive works copyright ownership and rules of conduct research. The full text is divided into four parts. The first part mainly discusses the cognizance of deductive works, that is, the essential elements of deductive works. The second part focuses on the study of attributions of deductive works, especially the copyright of infringing deductions. The third part discusses Trying to make a clear deduction of the rules and the limits of the work of the copyright of the works. The summary part gives a brief account of the deficiencies stipulated in the current Copyright Law of China.
