近年来,中国移动互联网事业蓬勃发展。笔记本电脑、平板电脑、智能手机等移动终端走进千家万户,越来越多的人可以享受移动上网带来的乐趣。但遗憾的是,移动新媒体平台之中著作权被侵犯的事件屡有发生,这与侵权归责原则不明确,导致侵权人意识不到自己的侵权行为、权利人缺乏维权意识有着直接关系。所以明确我国移动新媒体著作权的侵权归责原则,对于提升我国网民著作权的维权意识、促进移动新媒体平台的健康发展具有重要的现实意义。
In recent years, China’s mobile Internet business has boomed. Laptops, tablets, smartphones and other mobile devices go into every household, and more and more people can enjoy the fun of mobile Internet. However, unfortunately, the infringement of copyrights in mobile new media platforms has occurred frequently. This is not clear with the principle of infringement, which leads the infringers to realize that their infringement behavior is not directly related to the rights awareness of rights holders. Therefore, it is of great practical significance to clarify the principle of attribution of infringement on the copyright of mobile new media in our country and to raise the awareness of safeguarding the rights of Internet users in our country and promote the healthy development of mobile new media platform.
