国际投资争端往往涉及重大的公共利益,国际投资与服务贸易的密切相关,使得市场准入等原则对一国的开放程度起到至关重要的作用。在国际投资条约强调对投资者利益的保护下,也不能忽视对国家根本安全利益、对国家主权的保护。在国际仲裁实践中,也体现了对投资者私人利益的保护。仲裁的重要特点之一是保密性,这就使仲裁程序缺乏透明度,影响公众对仲裁考虑的监督。第三人参与制度也比较罕见,仅借助法庭之友有其不可避免的不确定性。因此,要提高仲裁程序的透明度,建立第三方参与制度,使国际投资自由化和公共利益双向互动,促进国际经济秩序的和谐稳定发展。
International investment disputes often involve major public interests. The close correlation between international investment and service trade makes the principle of market access crucial to the openness of a country. Under the protection of the interests of investors under the international investment treaties, the fundamental security interests of the state and the protection of state sovereignty can not be ignored either. In the practice of international arbitration, it also reflects the protection of the private interests of investors. One of the important features of arbitration is confidentiality, which makes the arbitration procedure less transparent and affects the public’s oversight of arbitration considerations. The system of third party participation is also relatively rare, with the unavoidable uncertainty of using only the friends of the court. Therefore, it is necessary to improve the transparency of the arbitration procedure and establish a third party participation system so as to enable bilateral investment liberalization and the public interest to interact in a bidirectional manner so as to promote the harmonious and stable development of the international economic order.
