被害人的诉讼地位随着历史的发展正在逐渐发生变化,是否赋予被害人当事人地位存在很多质疑,争议主要源于我国的价值理念以及诉讼文化等方面,笔者认为应该从刑法价值理念和诉讼结构方向来进行改善,进而最终确立被害人的当事人地位。
Victim’s litigation position is gradually changing with the development of history. Whether to give litigant status of litigants has many doubts.
