随着城市化推进和“经营城市”理念引导,全国各地纷纷出台旧城改造、土地征收拆迁政策,然而由于我国土地征收拆迁制度尚不完善,国有土地使用权产权界定不清晰,拆迁成本急剧攀升,加之拆迁过程中人本理念缺失,很多城市房屋拆迁工作频频出现问题,甚至引发激烈的矛盾纠纷,严重影响社会和谐稳定。本文着重利用新制度经济学中产权和交易费用相关理论,浅析土地使用权产权未清晰界定如何造成拆迁交易成本增加,进而提出一些可行性政策。

This article focuses on the theory of property rights and transaction costs in new institutional economics, and analyzes how the unclear definition of land use right property rights results in the increase of transaction costs of demolition and relocation, and then puts forward some feasible policies.
