2008年12月22日,十一届全国人大常委会第六次会议对《侵权责任法(草案)》(下称《草案》)进行了审议。这意味着距离《侵权责任法》的正式实施已为时不远。过去,由于侵权责任的分散立法,导致侵权责任的法律规定并不统一。涉及到医疗机构的法律,最典型的莫过于《医疗事故处理条例》。如果《侵权责任法》正式实施,类似《医疗事故处理条例》的单行法、行政法规不再适用,将给各级医疗机构带来较深刻的影响。因此,《草案》中有关医疗损害责任的规定备受医疗机构及医学法学人士关注,一些早就存在争议的问题,如医院对药害事件受害者是否应该担责、医疗纠纷的举证方式等,再次成为各方讨论的焦点。本栏目特邀请北京市华卫律师事务所郑雪倩主任于近几期对《草案》中与医疗机构相关的焦点进行解释说明,以供医院管理者参考。

Therefore, the provisions of the Bill on liability for medical damage have drawn the attention of medical institutions and medical law scholars. Some controversial issues have long been debated. For example, whether the hospital should take responsibility for the victims of the phytosanitary incident and the way of evidence of medical disputes, Once again become the focus of discussion of all parties.
