包括网上银行、电话银行、手机银行等在内的银行自助渠道是科技推动金融创新的结果,银行自助渠道在使客户逐渐脱离传统银行繁琐手续之时,又将他们拉入一种布满风险的境地。客户过错、技术风险都会引发非正常交易,规范传统银行业务的法规对其已有“难以承受其重”之感。相关法律规范的出台彰显了法律回应性特征,在责任分配上,我国先后出台的法规体现了一种从“偏离”走向“回归”的趋势。而立法内容及逻辑上的不足,使得责任倾斜配置仅局限在理论层面,为此,现有法律制度必须对其作出回应。
Self-service channels of banks, including online banking, telephone banking and mobile banking, are the result of financial innovation promoted by science and technology. When banks’ self-help channels gradually remove customers from the traditional cumbersome procedures, they pull them into a risky situation. Customer fault, technical risks will lead to abnormal transactions, regulate the traditional banking laws on its already “hard to bear the weight” of the feeling. The promulgation of relevant laws and regulations shows the characteristics of legal response. On the distribution of responsibilities, the laws and regulations successively promulgated by China have shown a tendency of changing from “deviation ” to “return ”. However, the legislative content and the lack of logic make the configuration of liability inclination limited to the theoretical level. Therefore, the existing legal system must respond to it.
