2001年末,由某企业清算组委托,上海一家拍卖公司主持了一场房地产拍卖会,拍品中有数10套位于上海西区的独立成套住宅,市民庄先生(化名)以46.1万余元的总价成功拍下了其中一套位于五楼的住宅。成交后,庄先生按规定支付了成交价款和拍卖拥金,并签订了《上海市房地产买卖合同》,办理了有关权属转让手续,取得了该房屋的所有权。
