互联网的普及,使社会大众以网络为载体,利用网络传播的自由性、开放性和交互性,在网络空间对政治、经济、文化和社会生活等方方面面的现象、事件,自由表达自己的观点和意见。但同时也对我国的司法审判产生了影响。本文分析了网络舆论对司法审判的影响,既肯定了网络舆论对司法公正的积极作用,也指出“舆论审判”对司法独立带来了消极影响,因此我国的司法机关应该变被动为主动,对网络舆论进行正确的引导与规制,不断完善司法制度,从而实现网络舆论监督的制度化、规范化和理性化。
