诽谤之中“诽”是背地议论,“谤”是公开指责。诽谤则为以不实之词毁人,是侵害公民或法人名誉权的一种方式。本文通过对雷诺兹特权的分析,探讨言论自由与公共利益两者的关系,探索如何实现言论自由与名誉权保护相统一,提出对我国新闻立法的思路构建的一点建议。
Defamation “slander ” is to talk about “slander ” is publicly accused. Slander is to use false words to destroy people, is a way of infringement of the reputation of citizens or legal persons. Through analyzing the Reynolds privilege, this article explores the relationship between freedom of speech and public interest, explores how to realize the unification of freedom of speech and the protection of reputation, and puts forward some suggestions on how to construct the news legislation in our country.
