美国第四巡回上诉法院案号:928 F.2d 104判决时间:1991年3月11日阅读提示商标的重要功能在于区分商品来源,给消费者以选择商品的权利。此外商标的质量保证功能也是商标权人所着力维持的重要内容之一,更是其商品能够持续畅销的关键所在。那么相同商标下的相同商品由于运输方式、标准的不同会造成对商标质量保证功能的损害吗?此时会对消费者的选择造成误导吗?本案法院认为商标权人有权控制其商标使用的行为,能够控制商标被许可人使用商标过程中所提供的商品的质量及存储、运输方式。若商标被许可人未按照商标权人的质量控制程序运输油料,则会对商标权人的商誉造成损害、造成消费者混淆。
