为解决反价格垄断执法实践遇到的新问题,需要结合我国实际和国际经验,从理论上研究价格垄断概念使用、行政执法机构设置、豁免承诺制度适用、价格行政垄断处理等问题。在具备法律实施外部环境和保障制度的环节,可以通过法律解释、指南,甚至修改法律和制定下位法,为执法部门适用法律提供立法支持。在不具备这些外部环境和制度保障的环节,宜加强市场经济配套基础设施建设,完善行政复议、行政诉讼和行政公开,在实践中摸索适用于我国特点的执法途径。
In order to solve the new problems encountered in anti-price monopoly law enforcement practice, it is necessary to combine the practical and international experience in our country to study the use of the concept of price monopoly, the establishment of administrative law enforcement agencies, the application of the exemption commitment system and the administrative monopoly of prices. With the legal implementation of the external environment and security system, the legal interpretation, guidance, and even the amendment of law and the establishment of subordinate laws can provide legal support for law enforcement agencies. Without such external environment and system guarantee, we should strengthen infrastructure construction of market economy, improve administrative reconsideration, administrative litigation and administrative disclosure, and find ways to enforce the law applicable to our country in practice.
