社会的和谐建立在平等正义的基础上,平等正义既包括政治层面上的法律地位平等与权利分配的公正,也包括经济领域中利益分配的公正;社会的和谐同时也是“以人为本”的价值取向。从这两个角度出发,法律应温情地关注弱者和弱势群体,尽量为他们提供机会优势,尽可能地消解经济上的落差所造成的社会隔膜,以达成弱强群体之间的和谐共处。
Social harmony is based on equality and justice. Equality and justice include not only the equality of legal status and the right distribution at the political level, but also the fairness of the distribution of benefits in the economic field. Social harmony is also the value orientation of “people oriented”. From these two perspectives, the law should pay close attention to the weak and disadvantaged groups with tenderness, try their best to provide opportunities for them and try their best to eliminate the social divide caused by the economic gap so as to achieve the harmonious coexistence between the weak and the strong groups.
