2008年1月1日新的劳动合同法开始实行。新法的颁布实施是在新的历史背景条件下,对现有的劳动关系进行规范,是为了更好的保护劳动者和用工单位。但是企业普遍认为新的劳动合同法的颁布增加了企业的用工成本,对于企业是十分不利的。本文从用工单位不签劳动合同处罚加重,解除劳动合同难度增加,以及试用期不再可以乱用三个方面进行了分析,并简要提出了自己的应对策略,以期对企业有所帮助。
January 1, 2008 The new labor contract law came into force. The promulgation and implementation of the new law is to standardize the existing labor relations under the new historical background so as to better protect workers and employment units. However, it is generally believed by enterprises that the promulgation of a new labor contract law increases the labor cost of an enterprise and is very unfavorable to the enterprise. This article analyzes the employment units from the three aspects of aggravating the penalty of not signing the labor contract, the difficulty of lifting the labor contract, and the probation period can not be used indiscriminately. The article also puts forward its own coping strategies briefly in the hope of helping the enterprises.
