民法总则出台后,民法典编纂都应当在民法总则的统辖下具体展开,各分编都要与民法总则相协调,以民法总则确立的立法目的、基本原则、价值理念为指导,对现行民事法律规范进行系统整合,编纂出各分编,从而形成一部适应中国特色社会主义发展要求,符合我国国情和实际,体例科学、结构严谨、规范合理、内容协调一致的法典。
After the promulgation of the General Provisions of Civil Law, the compilation of civil codes should be carried out under the jurisdiction of the General Provisions of Civil Law. All the sub-divisions should be coordinated with the general provisions of the Civil Law. Guided by the legislative purposes, basic principles and value concepts established in the General Principles of Civil Law, Standardize the system integration, compile each sub-section, thus forming a to adapt to the development of socialism with Chinese characteristics, in line with China’s national conditions and reality, science, rigorous structure, standardized and reasonable, coordinated content of the Code.
