宽严相济的刑事政策是我国现在及一段时间内必须坚持的基本刑事政策。通过对《刑法修正案(七)》和《刑法修正案(八)》进行较为深入的分析,以及对法律条文进行对比来阐述宽严相济刑事政策在刑法修改方面是如何贯彻的。通过解决不合理的法定刑配置等途径,使宽严相济的刑事政策得到正确的贯彻落实。
The criminal policy of temper justice with mercy is the basic criminal policy that China must uphold now and for some time. Through a more in-depth analysis of the “Criminal Law Amendment (VII)” and “Criminal Law Amendment (8)”, as well as the comparison of the legal provisions to elaborate on how to implement the Criminal Policy of Temper Justice with Mercy in criminal law amendment. By resolving the unreasonable allocation of legal penalties and other means, the criminal policy of combining leniency and strictism has been correctly implemented.
