(2016年2月2日中国公证协会第七届常务理事会第七次会议通过)第一条为进一步提高小额遗产继承公证的办证效率,方便当事人取得小额遗产,根据《中华人民共和国继承法》、《中华人民共和国公证法》、《公证程序规则》和有关法律、法规、规章以及《中国公证协会专业委员会业务规则制定程序》的有关规定,制定本指导意见。第二条适用本指导意见办理小额遗产继承公证应当符合下列条件:(一)申请继承的单笔遗产数额不超过人民币五万元。
(Adopted at the Seventh Meeting of the Seventh Standing Committee of China Notary Association on February 2, 2016) Article 1 In order to further enhance the handling efficiency of notary inheritance of small inheritance and facilitate the parties to obtain small inheritance, according to the "Inheritance of the People’s Republic of China Law of the People’s Republic of China, Notarization Law of the People’s Republic of China, Notaries Procedural Rules, relevant laws, regulations and rules and the Procedures for Formulating Business Rules of the Professional Committee of China Notary Association. Article 2 Applying this Guideline to handle small inheritance and notarization should meet the following conditions: (1) The amount of single inheritance for applying for inheritance shall not exceed 50,000 yuan.
