为了禁止向企业摊派,国务院新近发布了保护企业的合法权益,《禁止向企业摊派暂行条例》。这是继《中华人民共和国全民所有制工业企业法》由七届人大一次会议通过之后,国务院颁布的第一个保护企业合法权益的行政法规,从而将禁止向企业摊派工作纳入了法制的轨道。向企业摊派问题,由来已久。从1982年起,党中央和国务院就多次发出通知,严令不准向企业摊派。但由于各方面对摊派含义的理解不一致,对禁止摊派的重要性认识不统一,对摊派责任者的惩处办法不明,以致摊派案件屡有发生,禁而不止。一些地区、部门和单位以各种借口,用红头文件的形式,向企业摊派。摊派名目之繁多,数额之巨大,趋势之加剧,已严重地影响了深化企业改革、推行企业承包经营责任制的发展,使企业叫苦不迭,深恶痛绝,社会各方面也群起而攻之。为此,国务院制定并发布了《禁止向企业摊派暂行条例》。这个暂行条例对摊派所包括的內容和形式作了明确地说明,并将摊派定义为“在法律、法规的规定之外,以任何方式要求企业提供财力、物力和人力的行为”。用法律的形式规定摊派的概念、什么样的行为构成摊
In order to forbid the apportionment to the enterprise, the State Council recently released the lawful rights and interests of protecting the enterprise and “Prohibiting the Apportionment of Provisional Regulations to Enterprises”. This is the first administrative law enacted by the State Council to protect the legitimate rights and interests of enterprises after the adoption of the “Law of the People’s Republic of China on Industrial Enterprises under the People’s Ownership” adopted by the Seventh National People’s Congress at the first meeting, thus putting the prohibition on the apportionment of enterprises to the legal system. Apportionment to enterprises has a long history. Since 1982, the CPC Central Committee and the State Council have issued many circular notices that the enterprises should not be assessed. However, since all parties have different interpretations of the meanings of the apportionments, they are not aware of the importance of banning apportioning and the methods of punishing those responsible for the apprehension are unknown. As a result, cases of apportioning have occurred frequently and banned. Some regions, departments and units use various excuses and red tape to apportion the enterprises. There are so many names and huge amounts of apportionment that the trend has been aggravated. This has seriously affected the deepening of the reform of enterprises and the development of the responsibility system for undertaking contracting operations so that enterprises complain bitterly and hated everybody. To this end, the State Council formulated and promulgated the Provisional Regulations on Prohibition of Apportionment to Enterprises. This Provisional Regulation clearly states the content and form of the apportionment and defines apportionment as “any act that requires the enterprise to provide financial, material, or human resources beyond the provisions of laws and regulations.” In the form of law provides for the concept of apportion, what kind of behavior constitutes a stall
