BOT投资模式是近年来被多国采用的新型投资、融资方式,它不仅能节约成本、降低风险,更能有效吸引外资、技术,加强基础设施建设。但作为一种复杂的系统工程,BOT涉及多方当事人利益,如何平衡各方当事人之间的利益并保护投资者正当利益就显得尤为重要。通过探讨BOT特许权协议的性质,文章旨在发掘政府特权背后更为重要的公共利益问题,在明确公共利益界定标准的基础上完善我国关于BOT的相关制度。
The BOT investment model is a new type of investment and financing mode adopted by many countries in recent years. It not only saves costs and risks, but also effectively attracts foreign investment and technology and strengthens infrastructure construction. However, as a complex systematic project, BOT involves the interests of multiple parties and how to balance the interests of all parties and protect the legitimate interests of investors is particularly important. By discussing the nature of the BOT concession agreement, the article aims to find out the more important public interests behind the government privilege, and to perfect our country’s system of BOT based on the definition of the standard of public interest.
