政府依法行政是我国法治国家建设战略中最为重要的一环。从法治建设的角度看,社会转型持续变动的现实,为我国的法治国家建设提出了一些重要的问题,即在社会转型和市场化的过程中,法治的一个重要目标就是要打破“地方保护主义”的制度性壁垒。这就要求我国依法行政的制度建设应当特别注重转变政府职能,建立科学民主的决策机制,理顺行政执法体制,完善行政监督制度。
